The Supreme Court heard arguments on November 8th on the constitutionality of the ban on partial-birth abortion. Congress passed the ban overwhelmingly in 2003, but three lower courts have ruled it unconstitutional.

Partial-birth abortion is typically used in the fifth or sixth month of pregnancy, but often as late as the ninth month. In the method, an intact baby is delivered feet first until only the head is left in the birth canal. The doctor pierces the base of the infant’s skull with surgical scissors before inserting a catheter into the opening and suctioning out the brain. One nurse who witnessed the procedure testified in court several years ago she saw the baby’s hands “clasping and unclasping” and its feet “kicking” before it was killed. Represenatives of the (pro-abortion!) American Medical Association have testified before Congress that the procedure is "barbaric" and "never medically necessary."

For federal judges to overturn the will of America's elected representatives would be a stunningly anti-democratic abuse of their position, for a rabidly extreme position which serves no legitimate purpose. While we know the Supreme Court is not supposed to make its decisions based on petitions, it's pretty obvious that they frequently are considering more than just the law; and we think they need to know how we -- the vast majority of Americans -- feel. Tell them, today.

To the Supreme Court:

Partial-birth abortion is a disgusting, barbaric procedure which even the AMA says is "barbaric" and "never medically necessary". The overwhelming majority of Americans have opposed it for more than a decade, and a similarly great majoirty of our elected representatives have followed the will of the people by banning it once and for all. But arrogant federal judges have overturned that ban. now it comes down to you.

We hereby excercise our First Amendment right of petition to demand you uphold the law. Partial-birth abortion is evil. So is an unelected court which unreasonably usurps the rights of the people. Do the right thing, uphold the ban, and restore our confidence in your judgment.
